This definition also includes the unit responsible for the company's website, ReraProperty.com.

User

Encompasses anyone who is a Subscriber/Advertiser(s) and Browser/Visitor(s), whether an individual or corporate subscriber for the Services. The term includes the signatory listed in the application form, along with their successors and permitted assignees. "User" or "You" also refer to any person accessing or availing the Services provided by the Company.

Services

Means the services provided by ReraProperty.com to the User, including property listing, search, advertising, and related platform features.

Date of Commencement

Signifies the date when the User's application for the service is accepted.

Date of Termination

Indicates the expiry date specified in the termination notice or letter, or the date when the services are scheduled to end.

Registration Data

Means the information provided by the User during registration on ReraProperty.com.

These Terms shall continue to form a valid and binding contract between the Parties and shall continue to be in full force and effect till the User continues to access the Site and avails the Services provided by the Company.

All properties listed on this platform are RERA-approved. ReraProperty.com operates exclusively as an intermediary marketplace for RERA-approved properties, facilitating transactions between sellers and buyers.

• Facilitates user account creation, allowing individuals to access personalized features for property search and management, including property search customization and preference management.
• Posting user profile and displaying the property listing on the platform, including property details, photos, and other relevant information.
• Browsing for properties on ReraProperty.com and its associated internet links.
• Post advertisement on ReraProperty.com and promoting the property listing through various marketing channels, both online and offline.
• Send advertisements and promotional messages through emails and messages.

You affirm and guarantee to the Company that you are at least eighteen (18) years old or older and possess the legal capacity to enter into a binding contract, as well as to comply with and fulfill these Terms & Conditions. Although individuals under the age of 18 may use the site's services, they must do so under the supervision and guidance of their parents and/or legal guardians, using the registered account of said parent/legal guardian.

Prior to uploading any content, making comments, or utilizing any other services on this site, you agree to register and provide your complete name, age, email address, residential address, and contact number.

The Subscription Fees for the Service provided will be in accordance with the rates specified on the "My Subscriptions" page or as determined by the Company periodically.

Liability for the Subscription Fees will begin from the Date of Commencement of services.

This clause will not apply to individual Users accessing or posting information on the Site for property purchase purposes, unless the Company exercises discretion to change the policy.

Payment for the services offered must be made in full in advance.

Once subscribed to, payments for services are non-refundable, and any amounts paid will be deemed appropriated.

Any potential refunds are solely at the discretion of the Company.

The User acknowledges and agrees that the Company reserves the right, at its sole discretion, to offset the amount paid by a subscriber/user against any amounts payable by the user to the Company under any other agreement or commercial relationship for other products/services.

The Company does not guarantee the accuracy or timeliness of refunds reaching the Subscriber's card/bank accounts.

The Company retains the authority to cancel or cease the publication of any content on its website or through any other means. The applicable cancellation charges payable by the User will be in accordance with the rates outlined.

Transactions on the Site are safeguarded and secure. Any information provided by the User during transactions is encrypted to prevent inadvertent disclosure to third parties. The User's credit and debit card details are neither received, stored, nor retained by the Company/Site. Instead, this information is directly supplied by the User to the authorized payment gateway.

To safeguard user identification and password secrecy, the User must take necessary measures, including regular password changes and refraining from sharing them with others.

The User acknowledges acquiring no rights to any assigned mailbox number, user identification, circuit reference, or codes from the Company.

In case of theft or loss of user identification, password, or security word, the User must immediately notify the Company via telephone and provide written notice.

The password and username provided by the Company are solely for use by the named organization and its authorized employees.

The User agrees not to use any software to automatically download or extract listings from ReraProperty.com database without prior written consent from ReraProperty.com.

ReraProperty.com shall not be liable for any fraudulent transactions or unauthorized deductions from the bank accounts of any User.

• To provide accurate, complete, and correct registration data during the initial application for the Services.
• The User acknowledges that any data entered on the Site will undergo mandatory verification by the Company.
• The User must obtain any licenses, permits, consents, approvals, or intellectual property rights required for using the Service at their own expense.
• The User agrees to comply with all notices or instructions provided by the Company to facilitate the use of the Service.
• The User is responsible for all applicable taxes and costs incurred in using the Site service(s).
• The User is solely responsible for all information retrieved, stored, and transmitted.
• The User must maintain the confidentiality of their password and user identification.
• The User is responsible for all activities occurring on their display name and password.
• The User agrees to promptly notify the Company of any unauthorized use or breach of their password or account.
• The User must make payments to the Company for the Subscription Fees when due.
• To confirm that they are over 18 years old and competent to enter into the contract.
• The User grants the Company a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable right to exercise copyright and publicity rights over material displayed in their listings.
• The User is solely responsible for any data entered on the Site and warrants that all data entered is true, correct, and exclusively theirs.

• The User is prohibited from allowing any person other than the authorized person(s) named in the application form to use the Service.
• The User must not resell or assign their rights or obligations under these Terms & Conditions.
• The User shall use the Service solely for the subscribed purpose.
• The User shall comply with all applicable laws of India relating to the Services.
• The User shall not use the Service for unlawful or fraudulent purposes.
• The User shall not send or receive any offensive or abusive messages through the Service.
• The User is prohibited from selling their listing to any third party and must use the services solely for personal use.
• The User shall not infringe the intellectual property rights of any person/party.
• The User shall not violate the security of the Site or gain unauthorized access to any information or accounts.
• The User shall not introduce any viruses or harmful components into the internet or Site network system.
• The Company strictly prohibits spam and any activities facilitating spam on the ReraProperty.com site.
• The User shall not engage in advertising or solicitation of other Users on the Platform.
• The User agrees not to host, display, upload, modify, publish, transmit, or share any prohibited information on the Site, including defamatory, obscene, or infringing content.

The logos, brands, trademarks, and service marks ("Marks") displayed on ReraProperty.com are either owned or used under license by ReraProperty.com or its associates. Accessing ReraProperty.com does not grant the User any license or right to use these Marks in any form or manner.

By providing access to ReraProperty.com, Users are granted a limited, non-exclusive, non-assignable, and revocable license to access and utilize the Services, contingent upon compliance with the terms and conditions of the Agreement.

YASHOM PROPERTIES DOT COM PRIVATE LIMITED upholds the Intellectual Property Rights of all parties and complies with all applicable laws in India.

All copyright, know-how, and other related intellectual property rights to the Services provided by ReraProperty.com shall exclusively belong to the Company.

From time to time, we may recommend or provide access to third-party software, applications, products, services, or website links. Your use of such Third Party Services is solely between you and the third-party provider.

The content of external websites, services, goods, or advertisements linked to our site is beyond our control. Hyperlinks to third-party websites are provided solely for your convenience.

We act as an intermediary in transactions between users and Third Party Providers and do not take possession of any products or services offered by Third Party Providers.

We do not offer refunds for goods purchased from the Platform for Third Party Services.

The Company retains the sole authority to modify, add, delete, or terminate the Service at any time, with or without prior notice to the User.

Either party to this agreement may terminate it by providing written notice of 30 days.

However, the Company retains the authority to terminate this Agreement immediately, without prior notice to the User if: (a) the Company believes the User has violated any terms and conditions of this agreement; (b) the User is non-compliant with applicable rules and regulations including RERA; (c) the Company or any regulatory authority determines that it is not in the public interest to continue providing the Service; or (d) the User is declared bankrupt or enters any compromise or arrangement with its creditors.

In the event of termination, the User remains liable for Subscription Fees up to the Date of Termination.

In the event of a violation of the Terms, the Company reserves the right to take appropriate legal action, including removing offending material, terminating your account, and excluding individuals who have violated the Terms & Conditions.

In summary, the Company retains the right to refuse service to anyone at any time, and to remove any listings or advertisements for any reason, without prior notice.

The User acknowledges that neither the Company nor its affiliated companies, directors, officers, or employees shall be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from the use or inability to use the service.

In no event shall the Company's total liability to the User for all damages or losses exceed the amount paid by the User to the Company related to the cause of action.

The User agrees to indemnify and hold harmless the Company, its Directors, employees, and Key Management Personnel from any third-party claims arising from advertisements, wrongful posting of property, or unauthorized posting of property.

Furthermore, the User agrees to indemnify, reimburse, and hold harmless the Company, its officers, directors, employees, and agents from any claims, actions, demands, liabilities, losses, or damages arising directly or indirectly from their use of ReraProperty.com.

Notification procedures: Notices to the User will be sent to the address provided on the Application Form, while notices to the Company should be directed to the address specified for such purposes.

For grievance redressal, any complaints, abuse, or concerns regarding content, comments, or breaches of terms should be promptly reported via written communication or email to info@reraproperty.com.

We shall ensure that your complaint is resolved within timelines prescribed by applicable laws.

It is hereby clarified that there exists no agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship between the Company and any User of the Service.

The User acknowledges that any claim or cause of action arising from the use of the Service or the Terms & Conditions must be filed within 30 days after such claim or cause of action arose, or it shall be deemed forever barred.

This Agreement, along with any dispute or matter arising from the incidental use of ReraProperty.com, is governed by the laws of India. The User and ReraProperty.com hereby submit to the exclusive jurisdiction of the courts in Nagpur, India.

Any controversies, conflicts, disputes, or differences arising out of these Terms shall be resolved by arbitration in Nagpur in accordance with the Arbitration and Conciliation Act, 1996. The tribunal shall consist of one arbitrator appointed by YASHOM PROPERTIES DOT COM PRIVATE LIMITED. The language of the arbitration shall be English.

The terms and conditions presented herein constitute the entire agreement between the Party/User and the Company, supplanting all previous arrangements concerning the subject matter outlined herein. By completing the registration process and/or checking the "I have read and accept the Terms of Use" box, the User acknowledges acceptance of this agreement.
